Syrian planes bomb factory in north, many killed

BEIRUT (AP) ? Activists say Syrian warplanes have bombed an olive press factory in the country's north, killing and wounding dozens of people.

Two activist groups ? the Britain-based Syrian Observatory for Human Rights and the Local Coordination Committees ? say the factory is west of the city of Idlib.

The LCC says at least 20 people were killed and many others wounded in Tuesday's raid, while the Observatory says "tens were killed or wounded."

Both groups depend on a network of activists on the ground around the country.

President Bashar Assad's regime has been launching intense raids on rebels in recent months.

Syria's conflict started in March 2011 as an uprising against Assad's regime, but quickly morphed into a civil war that has since killed more than 40,000 people, according to activists.

Health and environmental risk in flame retardants in building insulation

ScienceDaily (Nov. 23, 2012) ? Researchers in the United States are calling for a change to the US building codes, following a study showing that the mandatory flame retardants routinely added to foam insulation are not only harmful to human health and the environment, but also make no difference to the prevention of fire in buildings where a fire-safe thermal barrier already exists. Such a change would bring the US building codes in line with regulations in Sweden and Norway.

The research team, which is drawn from US-based centres of excellence including the University of California and the Lawrence Berkeley National Laboratory, conducted a thorough review of fire safety literature since the mid-1970s and conclude that the addition of halogenated organic compounds to plastic insulation materials such as polystyrene, polyisocyanurate and polyurethane is costly, ineffective and environmentally damaging. Their conclusions are published in the latest issue of the journal Building Research and Information.

Led by internationally renowned fire expert Dr Vytenis Babrauskas of Fire Science & Technology Inc., the research team investigated the impact of the "Steiner Tunnel test," which is used to test the propagation of fire over the surface of all sorts of building materials in the early stages of fire (before flashover point is reached). Their paper suggests that changing the US building codes to exempt foam plastic insulation materials from the test would avoid the use of thousands of tonnes of flame retardants that are known or suspected to be persistent organic pollutants. They conclude:

"Such a change would ? decrease the cost of foam plastic insulation and encourage the use of insulation materials for increasing building energy efficiency and mitigating climate change. The potential for health and ecological harm from the use of flame retardant chemicals would be reduced and the fire safety of buildings would be maintained.

Their article begins with a review of the development of the US building codes in relation to fire safety, and foam insulation in particular, and explains that foam plastics used for insulation have required a thermal barrier (usually 12.7 mm (1/2 inch) thick gypsum wallboard) since 1976. In addition, chemicals such as hexabromocyclododecane (HBCD) and Tris (1-chloro-2-propyl) phosphate (TCPP) are routinely added in order to meet the requirements of the Steiner Tunnel test. The building codes have never stipulated that chemicals be added to foam plastic insulation, however doing so is the most common way to meet the Steiner test. These additives are semi-volatile organic compounds (SVOCs) which do not bind to the insulation material and are known to be released into the environment throughout the life cycle of insulation. The chemicals can persist and accumulate, and have been implicated in thyroid hormone disruption and nervous system development problems and are potentially carcinogenic.

The experts suggest that exempting foam plastic insulation materials from the Steiner Tunnel test would mean there was no longer a need to add these flame retardants.

As well as presenting a detailed analysis of the problems associated with the Steiner Tunnel test, the article reviews the:

? Adequacy of the thermal barrier

? Fire propagation into a cavity constructed in violation of codes

? Behaviour of exposed foam insulation installed in violation of codes.

The article also discusses alternative courses of action, including the possible development of a more accurate test, the use of different flame retardant chemicals and a range of options for mitigating the impact of the flame retardants currently used.

Finally, the article says that such an action would not be without precedent. Flame retardants were once routinely added to children's pajamas, but their use was discontinued in many regions after a range of adverse environmental and health impacts were identified. Dr Babrauskas and his team conclude that, in the light of their evidence, an equivalent volte-face should be implemented in the US building codes as soon as possible. They also recommend a root and branch review of the process of designing fire standards and building codes, in particular to ensure that fire scientists, building code officials and other regulators consider the efficacy, life cycle, health and ecological impacts of building materials.

Design and Features
The Mac mini is just what you expect from an Apple product. The design is the very picture of minimalist refinement, a CNC-milled aluminum block housing a full desktop-worth of hardware. And, true to form for Apple, it looks exactly like the previous iteration, and very similar to the model before that?the last easily spotted change on the Mac mini was when Apple dropped the optical drive and added a Thunderbolt port.

Measuring 1.4 by 7.7 by 7.7 inches (HWD), the compact Mac mini is small enough to sit unobtrusively on your desk, next to your display and keyboard. The rounded corners and subtle curves will be familiar looking to anyone that's seen an Apple product in the last few years. Unlike other tiny desktops that set up vertically, like the Polywell Poly i1000A-3770T , the Mac mini sticks with the low horizontal design it has used for years. On the top is a glossy black Apple logo; on the bottom is a round black plastic hatch. It can be opened without any tools, giving you a limited view of the internals, only providing real access to a few specific components. RAM modules can be added and swapped, the fan removed for cleaning, though the rest of the components can be accessed, assuming you have the necessary tools and a lot of patience. In such a small, tightly packed package, there's not really room for upgrades.

Apple has beefed up several features in the new Mac mini. The USB ports have all been upgraded to USB 3.0, though the ports aren't labeled as such, nor do they have the blue port connectors to indicate as such. Joining the faster USB ports are the same port used before, with a Thunderbolt port (which doubles as a mini-DisplayPort), FireWire 800 connection, HDMI output, an SDXC card slot, and audio line in and line out connections. Gigabit Ethernet is joined by 802.11n Wi-Fi and Bluetooth 4.0. It's a robust selection of features for such a small system; other compact desktops often drop features in the interest of saving space, such as the Shuttle X6100 , which omits Wi-Fi connectivity.

The processor has been upgraded to the latest Ivy Bridge technology, and our review unit was outfitted with a 2.3 GHz Intel Core i7 quad-core processor and 4GB of 1600MHz DDR3 memory. Last year's $799 mid-tier model had a Core i5 processor in it. There are also 8GB and 16GB configurations available (for an extra $100 and $300, respectively). Graphics processing got a bump with the integrated Intel HD Graphics 4000, but this time around there is no configuration available with a discrete GPU. The Mac mini also equipped with Apple's new Fusion drive technology and the latest version of Mac OS X Mountain Lion.

Fusion Drive
The Mac mini's specifications tell us that our model is equipped with a 1.12TB Fusion Drive, but that's not even half of the story. Apple's Fusion Drive combines hard disk and flash storage?Apple's nomenclature for both solid-state drives and custom flash modules?but it's neither a hybrid drive, nor is it a traditional dual drive. Instead of there being two drive volumes to manage (which can be a nuisance for the tech savvy, and downright mystifying for others), the Mac mini presents the two drives as one volume. As far as managing your files and programs, that's all you need to know, because the Fusion Drive software does the rest.

Pull back the curtain a bit, and there's more going on. Every piece of data?be it program, media file, document, and even the operating system?is initially written to the 128GB of Flash storage to provide the faster performance offered by Flash media. As your data is used from day to day, however, the drive shifts the less frequently used data to the 1TB hard drive, which offers slower speed, but more storage capacity. The result is speedy SSD performance for the data you use most frequently, without the cramped storage you'd contend with on a pure SSD.

What makes this set up different from hybrid drives, however, is that the Flash storage is not acting as a cache, mirroring data from the drive. Also, the evaluation process is ongoing, continuously evaluating each piece of data as it is accessed by the user, shifting it back and forth to maximize performance. Once your Mac mini gets into a routine and is optimized, this setup can save wear and tear on the spinning hard drive, since oft-used programs and files will eventually reside on Flash storage. All of this work happens in the background, with data evaluated in real time, and shifted to and from the Flash storage during idle times so as not to slow down performance during data intensive actions. From the algorithmic evaluation of data use to the shifting of data, it all happens seamlessly in the background, and offers optimal performance without the need for constant tweaking.

Mac OS X and Software
Like the other members of the current Mac family, the Mac mini comes preinstalled with OS X 10.8 Mountain Lion (OS X 10.8.2 on our review unit), along with programs from iLife 2011, like iTunes, iPhoto, iMovie, and GarageBand. The programs themselves are top-rated, and Mountain Lion itself was picked as one of the best tech products of 2012. It also features all of the same gesture support seen in the MacBook Pro line-up, so you might consider getting an Apple Magic Mouse or Magic Trackpad to take advantage of the intuitive controls.

In addition to the operating system and programs, Apple covers the Mac mini with a one-year warranty, and offers free tech support for the first 90 days after purchase. For extra protection and longer coverage, you can also purchase AppleCare ($149 per year).

Performance
Apple Mac mini (Late 2012) With the new processing hardware, and the bump from dual-core Core i5 to quad-core Core i7, the Mac mini (Late 2012) more than doubled the processing performance over the previous iteration, scoring 5.95 points where the Mac mini (Thunderbolt) scored 2.69 points. It's necessarily a fair comparison, however, because the hardware is so different. Alternatively, the Polywell Poly i1000A-3770T, which has a 2.5GHz Intel Core i7-3770T processor, scored 6.30 points.

Apple Mac mini (Late 2012)

The Mac mini also made quick work of our current multimedia tests, finishing Handbrake (version 0.9.8) in 37 seconds, and Photoshop CS6 in 3 minutes 58 seconds. While the Polywell Poly i1000A-3770T has slightly faster raw performance, the Mac mini's Core i7 still offers enough processing power to continue to feel speedy even after a few years of use.

Though the integrated Intel HD Graphics 4000 is more than sufficient for most day-to-day tasks, it isn't enough to support high-end 3D gaming. When tested with Heaven at both medium and high settings, it failed to produce playable results, rendering 19 frames per second (fps) and 12 fps, respectively. The Intel HD Graphics 4000 are certainly enough to play games with lighter requirements, such as Torchlight or one of the World of Warcraft titles.

While this configuration may not be the most inexpensive member of the Mac family?the starting configuration sells for a more affordable $599?the Apple Mac mini (Late 2012) compact desktop offers top features and performance to spare. While the previous Editors' Choice Polywell Poly i1000A-3770T does boast a slightly beefier processor, it doesn't offer the highly polished refinement offered by Mac mini. The seamless 1.12TB Fusion Drive is superb, and the array of display outputs and connectivity options is far larger than most compact desktops can muster. Add in the beautiful design and industry-leading operating system, and the Mac mini is an easy pick for our Editors' Choice.

Nov. 25 (Bloomberg) -- Dubai?s ruler announced plans for a development boasting the world?s biggest shopping mall and gardens larger than London?s Hyde Park, as the emirate revives property projects on hold since the global financial crisis.

Emaar Properties PJSC, the United Arab Emirates? largest developer by market value, and Dubai Holding LLC will together build a district called ?Mohammed Bin Rashid City,? named after the Persian Gulf emirate?s ruler. The project near central Dubai is to include 100 hotels, residential areas and green spaces 30 percent bigger than Hyde Park, according to an e- mailed statement yesterday.

Dubai already has bragging rights to the biggest emporium by total area, Dubai Mall, which sprawls opposite the planet?s tallest skyscraper, Burj Khalifa. Between these two Emaar structures is a man-made lake where the world?s largest dancing fountain shoots water 50 stories high.

Dubai, seeking to stimulate its economy, wants to resume several projects that halted after the global credit crunch drove down property values by 65 percent and caused companies to suspend construction of hundreds of developments. Builders in the U.A.E. have aborted about $757 billion of projects since the crisis, Citigroup said in a report on Oct. 16. Dubai is the country?s second-largest emirate, after Abu Dhabi.

Desert Venice

Meydan City Corp., which built a 60,000-seat horse-racing stadium and hotel complex in Dubai, said in October it would revive plans for two developments, one with low-rise buildings and lagoons and the other for a tower with ?sky gardens? and nine swimming pools. At about the same time, the emirate?s government re-approved construction of a mile-long (1.6 kilometer-long) canal from the Business Bay commercial area to the ocean.

New projects announced in the past two months include a replica of India?s Taj Mahal that would be four times the size of the original.

Emaar?s shares climbed 2.2 percent today to 3.73 dirhams, the highest close since Oct. 23. The company?s shares have jumped 45 percent this year.

?The current facilities available in Dubai need to be scaled up in line with the future ambitions for the city,? Sheikh Mohammed Bin Rashid Al Maktoum said, according to the official statement. ?We have to start work immediately? on the project and boost the economy, he said.

Sheikh?s Vision

Under the ruler?s plan, Mohammed Bin Rashid City would span 5.1 square kilometres (2 square miles) and contain the biggest cluster of art galleries in the Middle East and North Africa. It?s so-called ?Mall of the World? would cater to 80 million shoppers a year.

The announcement didn?t specify the development?s expected cost or a construction schedule.

Dubai racked up $113 billion of debt transforming itself into a tourism and commercial hub. The emirate has $7 billion of debt maturating next year and $32 billion in 2014, according to a Bank of America Merrill Lynch report Oct. 20.

A construction boom in the emirate, where developers began selling property to foreigners in 2002, led to several large projects including the world?s tallest tower and man-made islands off the coast. Work on two of three palm-shaped residential islands was interrupted as the bonanza turned to a bust in the third quarter of 2008.

Is Chambliss move a signal of GOP rebellion against hardline tax stance?

WASHINGTON (Reuters) - Senator Saxby Chambliss this week became the latest Republican lawmaker to loosen his ties to Grover Norquist, the anti-tax lobbyist famous for getting elected officials to sign a "taxpayer protection pledge."

The rebellion, albeit a modest one, comes as Republicans prepare to negotiate with Democrats and President Barack Obama on a deal to avert the so-called fiscal cliff - some $600 billion in tax increases and spending cuts set to start jolting the economy at the beginning of 2013.

"I care more about this country than I do about a 20-year-old pledge," Chambliss told Georgia television station WMAZ on Thursday. "If we do it his way, then we'll continue in debt, and I just have a disagreement with him about that."

A vast majority of elected Republicans have signed the pledge Norquist created in 1986, which commits them to voting against tax increases, and it became a type of litmus test among U.S. conservatives.

But its influence, and that of Norquist's organization, Americans for Tax Reform, may be waning following Republican losses in this month's elections and acknowledgments from Republican leaders that revenue must be raised to pare deficits topping $1 trillion.

"Grover Norquist has no plan to pay this debt down. His plan says you continue to add to the debt. I just have a fundamental disagreement with him about that," Chambliss said.

Norquist, in response, noted that Chambliss was an author of an open letter to him last year from three Republicans promising support for revenue generation from the "pro-growth effects" of lower tax rates.

"Senator Chambliss promised the people of Georgia he would go to Washington and reform government rather than raise taxes to pay for bigger government," Norquist said.

Some Republicans contend they are only open to raising revenue through economic growth, an impact hard to quantify and which Democrats and many economists say is not nearly enough.

Republican aides on Capitol Hill have been grumbling privately about the attention Norquist gets, worrying that it weakens their ability to negotiate across the aisle.

Representative Scott Rigell, a Republican who won re-election despite disavowing the pledge, expressed similar sentiments publicly in a November 17 interview on CNN.

Rigell said he was a businessman and would "go where the numbers lead me. And a careful analysis of our budget and trying to reconcile that with the Americans for Tax Reform Pledge led me to the clear decision that the pledge itself is an impediment to meaningful tax reform."

Norm Ornstein, a political scientist at the conservative-leaning American Enterprise Institute, said such comments showed taking on Norquist was not as risky as it used to be.

"Taking on Grover Norquist at this point is not the kiss of death it was a year or five years ago," Ornstein said. "Especially when you have a president winning re-election after making raising taxes on the rich a centerpiece of his campaign."

DEBT, POLARIZATION

By signing the pledge, lawmakers agree to "oppose any and all efforts to increase the marginal income tax rate for individuals and business," and "oppose any net reduction" or elimination of deductions and credits, unless it is matched dollar for dollar with further tax rate cuts.

Chambliss is a member of the so-called Gang of Eight group of senators, a bipartisan alliance working for deficit reduction, formed last year when the country was on the verge of default thanks to a partisan battle over raising the country's borrowing limit.

Among the other Republicans who have expressed misgivings about the pledge in recent months are Senator Lindsey Graham and Representative Steve LaTourette, who is leaving the House, citing the polarized climate in Washington.

The new House of Representatives, which starts work in January, has 16 Republicans who have not signed the pledge, up from six in the outgoing Congress. One new Republican senator, Jeff Flake, also has not signed.

Democrats believe they have the upper hand in talks, after Obama's win over Republican challenger Mitt Romney in a campaign in which Obama stressed the need for the wealthy to pay more in taxes.

Speaking on the sidelines of a Washington event last week, Norquist told Reuters: "People don't always take the pledge first when they run. A lot take it after they have been there for a while. The pledge isn't the only vehicle for stopping tax increases."

Chambliss, who is up for re-election in 2014, was asked in the interview whether Norquist would retaliate against him.

"In all likelihood, yes," Chambliss said.

The yen, a long-time safe haven currency, recovered against the Australian dollar following the news out of Brussels, dragging the AUD/JPY price down to two prospective sources of support ? a one-hour 55 ema and a trendline defined by the 13th, 15th, and 16th daily lows ? sitting near the 84.55 level.

The AUD/JPY finished the trading week at its highest daily close in eight months. Currency traders who established and held a long position from the 84.60 area might have a new carry trade on their hands.

French tennis coach convicted of raping players

PARIS (AP) ? A former tennis coach in France has been convicted and sentenced to eight years in prison for raping young players attending the academy he used to run in Saint-Tropez.

The court in Lyon also barred Regis de Camaret from working in tennis for life.

The case began with a book by a former ranked player who described years of abuse by Camaret, now 70. Several other women later came forward with accusations that Camaret raped or sexually abused them when they trained in the 1980s and 1990s. The statute of limitations had run out for most of the accusers.

Former No. 3-ranked player Nathalie Tauziat testified on his behalf at the trial.

Camaret has said that the atmosphere at his academy was "conducive to flings," the Sipa news agency reported.

2 killed, 60 wounded in Afghan suicide attack

(AP) ? A suicide attacker detonated a car laden with explosives Friday in eastern Afghanistan, killing two civilians and wounding about 60 others, officials said.

Taliban spokesman Zabiullah Mujahid claimed responsibility for the bombing, saying in a statement that the attack was in response to the recent execution of four Taliban detainees at the Afghan government's main detention center in Kabul.

The men were convicted and sentenced to death in Afghan courts for a variety of crimes, including murder, rape, kidnapping, robbery and cruelty against children. The Taliban condemned the hangings, saying the detainees were prisoners of war who were unjustly jailed.

Shahidullah Shahid, a spokesman for Wardak province, said the blast went off shortly before 7:30 a.m. on a street where international and Afghan security forces have a coordination office. He said at least two people were killed and 60 others were wounded in the explosion.

The Taliban said two suicide bombers were involved in the attack in Maidan Shahr, the capital of Wardak province. The insurgent group claimed the two attackers killed tens of Afghan and international troops, although the Taliban often exaggerate the number of casualties caused in their attacks.

Afghan and international forces have been working to root out insurgents in Wardak province to keep them from moving north into the Afghan capital. The international forces are scheduled to turn over security responsibility to local troops by the end of 2014.

PST: Chelsea fires Di Matteo, hires Benitez

Hours after they parted ways with the man who won them their first European title, Chelsea?s moved on to a man whose reputation hinges on his UEFA Champions League success.

With the appointment of former Liverpool manager Rafa Ben?tez today, Chelsea?s replaced Roberto Di Matteo, if only in the short-term. Given the job of seeing out the 2012-13 season, Ben?tez appears to be doing little more than keeping a seat warm for Roman Abramovich?s true ambition ? Pep Guardiola.

Here?s the club?s statement:

Chelsea Football Club can confirm Rafael Benitez has been appointed interim first-team manager until the end of the season.

The owner and the Board believe that in Benitez we have a manager with significant experience at the highest level of football, who can come in and immediately help deliver our objectives.

The 52-year-old Spaniard is due to meet the players at the training ground in Cobham tomorrow

Those objectives are unlikely to include UEFA Champions League, where Chelsea?s fate now depends on Juventus losing in Donetsk on matchday six. Of course, that could happen, and if it does (while Chelsea beats Nordsjaelland), the Blues will have a man whose reputation has come to rest on his Champions League accumen. If not, there?s always the league, two domestic cups, and Europa League.

It?s a good appointment for everybody except Di Matteo, who likely would be in a job today had Ben?tez been either unavailable or unwilling to subjugate himself to a temporary position.

Such has been Ben?tez?s fall. After guiding Liverpool to second in the Premier League in 2008-09, he allowed Liverpool to slip to seventh place, the failure to make Champions League beginning a slide from which the club?s still recovering. Ben?tez?s subsequent inability to replace Jos? Mourinho at Inter Milan meant the former Valencia boss?s best route to a marquee job was a situation like Chelsea?s.

Let?s also not forget the nature Ben?tez?s failings in Milan, because they?re particularly relevant to his potential success at Chelsea. We should take managerial hubris and put it aside, because Ben?tez has likely been dissuaded of notions that had him shrug off his part in Liverpool?s downfall. The state he left Internazionale in was bad enough.

There he inherited an old team coming off a Mourinho-led European title and not only changed how they played but ran his veterans into the ground. There?s more than one similarity to be drawn between that Inter side and Ben?tez?s new charge. By the time the Nerazzurri took off for 2011?s Club World Cup, they were depleted, mutinous, and out of chances for their ill-fitting coach.

While Ben?tez is not directly replacing Mourinho in London, he will again be faced with expectations raised by the Special One. Even after Di Matteo delivered the one prize Jos? couldn?t claim, standards at Stamford Bridge reflect the demands of a man five years gone. If Ben?tez is going to retain his job, he has to claim the league, FA Cup, or Europa League. And as Di Matteo?s travails show, even that might not be enough.

Because if Ben?tez is to win silverware during his Stamford Bridge residency, it will likely be through the same pragmatism that characterized his most successful times at Anfield. It?s not ugly, it?s not anti-football, but it?s also not Barcelona. And for whatever misguided reasons Roman Abramovich is using to fuel his decisions, Chelsea?s owner won?t be happy until his team is playing the brand of soccer he?s wanted since the day he bought the club.

The lack of style undid Mourinho. It undid Di Matteo. And it will likely undo Ben?tez, regardless of results.

The one thing that could keep Ben?tez in London past May 2013 is if Guardiola goes elsewhere, because for everything we?ve heard about Abramovich?s lust of Pep, we?ve heard little of reciprocation from the former Bar?a boss. We know he prefers England. We know he prefers London. We also know that he?s unlikely to make any decisions until early-2013, if not later.

All of which makes the treatment of Di Matteo more curious. Replacing a club icon with a former rival is precarious enough (though Chelsea fans will likely recognize Ben?tez?s qualities). To do so when it?s unclear if lack of a striker or thin central midfield are the real problems hints Di Matteo was never going to be embraced by Abramovich. It didn?t matter that Di Matteo?s Champions League troubles came in a group with two of the top eight teams in Europe. That he lost provided Arbamovich an out from a man he never truly wanted, even if it made more sense to keep him until the Guardiola question was resolved.

With no answers in sight, Chelsea fans are best served concentrating on the present. They aren?t the best team in England, but they?re capable of competing for the title. Perhaps Ben?tez will bring something new out of them. Cup competitions have taken on a special meaning for the Blues. They?re still alive in both. And even if Europe only offers Europa League, the team has enough young, exciting talents to make that congestion-inducing tournament worth a Chelsea-supporters? time. There?s still plenty of light in this 2012-13 tunnel.

Roberto Di Matteo won?t be driving them through it, but it?s time to move on. All aboard the Rafamobile.

The review,?by a group sponsored by?the National Institute of Justice, was solicited by Gusman following last month's high-profile failure to track down a teen suspected of committing crimes after his ankle monitor went offline for more than a day.

The 14-page report by the Corrections Technology Center of Excellence found numerous systemic problems with a program that oversees about 100 juveniles and adults assigned electronic monitors in Orleans Parish.

Notably, it says two additional deputies and a supervisor should be assigned to the team that tracks the bracelets, which would nearly double the current staffing of three deputies and a supervisor.

As it stands, there is no live staffing for nights and weekends, the report said.

On-call deputies are assigned to respond to alerts during those times, but the sheer number of alerts for curfew violations and failures to charge ankle bracelets make it "a frustrating experience" for the on-call deputies, the report said.

"The number of staff assigned to the EMP is insufficient to monitor a program that requires responses to alerts on a 24/7 basis," the report said.

Gusman said Wednesday that he?is working?to hire one additional deputy to join the monitoring team, and that he has assigned staff at the sheriff's 24-hour communications office to bridge the gap.

The report also says that juvenile offenders are quick to notice weak enforcement of the program, which monitors both criminal offenders and runaways. The report recommends ridding the program of the runaways,?a reform that?would take cooperation from juvenile court judges.

"The team felt these individuals have little reason to change their behavior and, in fact, may become more rebellious toward authority as a result of a requirement to wear a tracking device," the report said. "Most have a history of running away, and this propensity is not changed by applying an ankle bracelet."

Part of the problem, the report found, is that the sheriff's office lacks the autonomy to enforce the rules.

The report noted that the Youth Study Center's 36 beds are often filled up, leaving little consequence for kids who violate their conditions, such as curfew hours or "inclusion zones."

Judges also wield?too much control over conditions of the program and when ankle bracelet scofflaws should face punishment or termination from the program, the report said.

"I think one of the key recommendations is to stop the practice of using them for what we call families in need," Gusman said Wednesday, referring to runaways and other juveniles with family troubles but no criminal charges. "Clearly, there's nothing you can hang over their heads."

Gusman declined to say how often his office has gone out to detain juveniles who break their restrictions, but said it generally only happens "if they did a major violation - if they cut their strap, or allowed their battery to go all the way down."

He said the program had 103 people on ankle bracelets as of Wednesday, including 58 juveniles. About 10 of those were not facing criminal charges.

Currently, each judge sets their own conditions for people ordered to wear the monitors. They also set their own policies for when deputies should arrest someone if they violations.

The sheriff's office should consult with the judges, the report said, but the "ultimate responsibilities for acceptance and termination of participants should lie with the program, not the courts," the report said.

Juvenile Court Judge Ernestine Gray?could not be reached?Wednesday.

The review was conducted by George Drake, an expert on offender tracking technologies, and Sgt. David Scheppegrell of the Charlotte Mecklenburg Police Department in North Carolina, which has a monitoring program that New Orleans and others have looked to as a model.

Scheppegrill called it unusual?to have?a monitoring program "where the courts totally dictate who you're going to monitor and there's basically no say-so by the monitoring agency ...?with no way of really enforcing non-compliance.

"Electronic monitoring should be a middle step between living at home with freedom, and detention. If you're not willing to put someone on detention for not following the rules, they probably shouldn't have been on a monitor to start with."

He said he expects to see improvement in Orleans Parish, but it may come slowly.

"Word of mouth is a powerful thing. These kids talk to each other," he said of the lack of enforcement.

One key element that's lacking, Scheppegrill said, is an automated system that would allow police to run crime reports through the GPS system to see if?someone on a monitor was?at the scene of a crime. Gusman said?they do it manually, but not for all crimes. He said his office was looking into?an inexpensive solution.??

In the case of the juvenile who wore the failed ankle bracelet and is suspected in an armed robbery and carjacking last month, it is unclear whether deputies would have arrested him for veering away from his inclusion zone, even if the bracelet was functioning.

Citing confidentiality laws, Gusman has declined to specify the juvenile judge's conditions for the boy.

According to the report, the boy had allowed his tracking device to lose its charge, and a problem with a nearby cell tower caused confusion over the status of his device.

That may have contributed to deputies failing to respond appropriately to the alerts, since it appeared on a program screen that his ankle monitor was fully charged.

According to an earlier?report from OmniLink, the company that runs the tracking system, the first ankle monitor assigned to the boy malfunctioned, and a new monitor had similar problems. They were attributed to a cell-phone dead zone that prevented?it from communicating back to the company.

The new monitor was not communicating with servers for at least 24 hours, during which time, police say, the teen committed an armed robbery and a carjacking in an Uptown neighborhood on Oct. 2.

The area of at least one of the crimes fell outside his allowed geographical area. There was no evidence the boy had tampered with the monitor, Gusman said.

Gusman, however, said the deputy failed to heed a time stamp that showed the status of the monitor - indicating it was fully charged - was outdated. The deputy was suspended for a day, Gusman said.?

Police say around 10 p.m. on Oct. 2, the teen robbed someone at gunpoint and then carjacked a woman at gunpoint along with at least one other teen, a 16-year-old. Both teens were arrested after jumping out of the carjacking victim's stolen car when police were tailing them on Oct. 3, police have said.

In spite of this mishap, Gusman has insisted that monitoring program has been a "very effective alternative to incarceration" since its implementation in October 2010.

The experts are due back in six months for a follow-up review, Gusman said.
